IGNITE YOUR FIYAH, FIYAH Movement Wellness with PHOENIX

REFUND POLICY:
ALL Classes, Consultations, Sessions, Workshops are non-refundable and non-transferable.

CANCELLATION/NO SHOW POLICY:
If classes, consultations, private sessions, live events are missed due to non attendance, then this is done so at the responsibility of the client and will not be refunded or transferred. There are automatic alerts, however please take a moment at time of purchase to set your alarm with your class scheduled in your calendar.

ALL CLASSES ARE FILMED IN THEIR ENTIRETY OR IN PARTS. PLEASE REFER TO INFO BELOW.

MISC.
Ignite your FIYAH/Jessica Phoenix reserves the right to cancel a class in emergency situations. Registered individuals will be notified at least 3 hours prior to the start of class if there is a cancellation. Please make sure your contact information is up to date when you register for classes.

Class Packs, Monthly packages and Memberships cannot be refunded or returned, extended, suspended, exchanged or transferred between persons.

Merchandise
All FIYAH Culture and Wellness Products purchased are final sale only. We do not issue refunds. There are no returns or exchanges.

By registering & participating in FIYAH classes, gatherings, sessions, retreats, Private Sessions, workshops led by JESSICA PHOENIX, Participants agree to the following statements:

1. I understand that FIYAH/JESSICA PHOENIX records all or parts of in person and online classes to continue spreading the word about her offerings and business, and that if I do not want my image, voice, or representation to be included or distributed as part of class recordings, I will inform the instructor in person or, if online, turn off my video or audio prior to participating. Recorded classes may be distributed in whole or in part for marketing, promotional, or other business activities. Private clients may record with permission. No consultations will be recorded.

2. I am voluntarily participating in Ignite your FIYAH classes, sessions, retreats and programs led by JESSICA PHOENIX, including online and in-person classes, sessions, workshops, and training involving Yoga, Dance, Fitness, Meditation, Wellness, and Health. I recognize that these activities require physical, mental, and emotional exertion and may involve unfamiliar movement that may be strenuous if performed incorrectly and may cause physical injury. I am fully aware of the risks and hazards involved.

3. I understand that it is my responsibility to consult with a physician before participating. I agree to disclose any medical condition that may affect my participation. I acknowledge the instructor does not diagnose, treat, or advise on any medical condition. I am responsible for maintaining the health necessary to engage in this activity.

ASSUMPTION OF RISK
I am voluntarily participating entirely at my own risk. I am aware of risks associated with traveling to and from, and participating in, this activity, including physical or psychological injury, pain, illness, disfigurement, temporary or permanent disability, economic or emotional loss, and death. These outcomes may arise from my own or others’ negligence, travel conditions, or the activity location. I assume all related risks, known and unknown, including travel to, from, and during this activity.

I agree to indemnify and hold harmless Ignite your FIYAH, FIYAH Movement Wellness, FIYAH Retreats, and JESSICA PHOENIX against claims, suits, or actions for liability, damages, compensation, attorney’s fees, or related costs brought by me or anyone on my behalf. If these expenses are incurred, I agree to reimburse Ignite your FIYAH/JESSICA PHOENIX.

I acknowledge that this activity may involve a test of a person’s physical, emotional, and mental limits.

WAIVER AND RELEASE
I acknowledge that I have carefully read this Waiver and Release and fully understand that it is a release of liability. I expressly agree to release and discharge IGNITE YOUR FIYAH/JESSICA PHOENIX from claims or causes of action and voluntarily waive any right to bring a legal action for personal injury or property damage. To the extent permitted by law, this release also applies to negligence by IGNITE YOUR FIYAH, FIYAH Movement Wellness, FIYAH Retreats, and JESSICA PHOENIX.

If I require medical care or treatment, I agree to be financially responsible for costs incurred. I understand that I should carry my own health insurance.

This Agreement was entered into at arm’s-length, without duress or coercion, and is to be interpreted as an agreement between parties of equal bargaining strength. Both the Participant and IGNITE YOUR FIYAH/FIYAH Movement Wellness/FIYAH Retreats/JESSICA PHOENIX agree that this Agreement is clear and unambiguous and will be interpreted based on its language and the purposes for which it is entered into.
